Overview
When you sign up to use Searchly, you automatically confirm that you accept all the terms in this agreement. Ownership
Your Data is defined as the data you explicitly send to Searchly through its API or SDKs. Searchly does not claim ownership or copyright of your data. You agree that you are responsible for, and that you own the rights to the data you send to Searchly. You are responsible for keeping your private data private (including your account password and your API Keys), and for protecting any sensitive content you send to Searchly by using encrypted transmission (with encrypted protocols such as HTTPS) and showing your data only to authorized persons.
Quality of Service
We commit to a monthly uptime of 99.7%, provided you keep your indexes within the limits defined for your account.
Data Privacy
Refer to the Privacy Policy for Searchly's Data Privacy commitments.
Disclosure
TheSaaS may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service.
Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
You may cancel your Searchly subscription at any time; however, there are no refunds for cancellation.
Limitation of Liability
IN NO EVENT SHALL SEARCHLY, ITS DIRECTORS, OFFICERS, AFFILIATES OR AGENTS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO THE SERVICES OR THE ARRANGEMENTS CONTEMPLATED HEREIN.
EXCEPT AS SPECIFIED IN THESE TERMS, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, INCLUDING RESPECTIVE DATA PRIVACY LAWS, THE SERVICE PROVIDED BY SEARCHLY IS PROVIDED “AS IS” WITHOUT ANY KIND OF WARRANTY. SEARCHLY IS NOT RESPONSIBLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, DAMAGE, OR CONSEQUENTIAL DAMAGE RELATED TO YOUR USE OF THE SERVICE, OR INACCESSIBILITY OF THE SERVICE WHETHER FROM ERRORS OR OMISSIONS IN SERVICE OR ANY OTHER LINKED SITES OR FOR ANY OTHER REASON. USE OF THIS SERVICE IS AT YOUR OWN RISK. SEARCHLY DOES NOT REPRESENT OR WARRANT THAT ITS WEBSITES, ITS SERVER OR ANY LINKED SITES ARE FREE OF ANY HARMFUL MATERIALS.
